THE HAGUE, 29 December 2023. South Africa today filed an application instituting proceedings against Israel before the International Court of Justice (ICJ), the principal judicial organ of the United Nations, concerning alleged violations by Israel of its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide (the “Genocide Convention”) in relation to Palestinians in the Gaza Strip. An initial ruling was made on 26 January 2024.

South Africa submits an urgent request for the indication of additional provisional measures in its ICJ genocide case

THE HAGUE, 10 May 2024. South Africa today filed an urgent request with the Court for the indication of additional provisional measures and the modification of provisional measures previously prescribed by the Court in the case concerning Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v. Israel).

ICJ unanimously votes for additional provisional measures to prevent Gaza famine

The ICJ reaffirmed its 26 January provisional orders to Israel, with only the Israeli ad hoc judge and Judge Sebutinde again voting against, and ruled unanimously in favor of South Africa’s 6 March 2024 request for additional provisional measures to stop the famine in Gaza. The court also ordered Israel to not commit any of the crimes of genocide and to report back in one month.

Palestine announces its intention to intervene in South Africa genocide case against Israel at the ICJ

The Palestinian Ministry of Foreign Affairs and Expatriates, representing the State of Palestine, announced on 28 March 2024 its intention to intervene in South Africa’s ICJ case against Israel for violations of the Genocide Convention. Palestine also thanked Belgium and Ireland for also filing interventions, and called on all State Parties who are signatories to the Genocide Convention to do the same.
